Welcome to Warden. Warden helps you stay aware of what is happening around you by showing public safety information on a map. The information you see comes from public government sources and third-party data providers, not from videos or broadcasts made by users.

These Terms of Use (the “Terms”) are an agreement between you and 997 Labs FZC LLC, a free zone company registered in the United Arab Emirates (“Warden”, “we”, “us” or “our”). They govern your use of the Warden: Safety Map mobile application (the “App”), our website at wardenmap.com (the “Site”), Warden Premium (“Premium”) and everything we provide through them (together, the “Services”). The information, maps, text, graphics, software and data made available through the Services are the “Content”. Information about individuals listed on government sex offender registries is “Public Records Data”, and information about crimes, emergencies and other safety events is “Incident Data”.

By downloading, installing or using the Services, you accept these Terms and our Privacy Policy, which explains how we handle information and is part of these Terms. If you do not agree, do not use the Services.

Key notices#

Not an emergency service

Warden does not connect you to 911 or any emergency service and does not dispatch help. In an emergency, call 911 (or your local emergency number) immediately.

Automatic renewal

Premium subscriptions renew automatically through the store or provider you used to subscribe until you cancel. Apple requires cancellation at least 24 hours before renewal. See section 12.

Public records data

Registry information is for personal safety awareness only. It must not be used to harass, threaten, intimidate or discriminate against anyone. Misuse may be a crime. See section 3.

Terms at a glance#

This summary is for convenience only. The full Terms below control.

  • Information may be incomplete or delayed. Always verify with official sources.
  • Never use Warden to harass, confront or track anyone. Misuse may be a crime.
  • Not for employment, housing, credit or insurance decisions. Warden is not a consumer reporting agency.

1.Eligibility and risk assumption#

Who may use the Services

To use the Services you must:

  • be at least 18 years old;
  • be able to form a binding contract with us;
  • not be barred from using the Services under the laws of the United States or any other applicable jurisdiction;
  • not be located in a country subject to a U.S. Government embargo, and not be on any U.S. Government list of prohibited or restricted parties.

If you use the Services on behalf of an organization, you represent that you have authority to bind it, and “you” includes that organization.

Risk assumption

You understand that the incidents, locations and individuals shown in the Services may involve dangerous situations. You agree that you will not travel to, approach, remain near or interfere with any incident, registered address or individual shown in the Services, and that you will not investigate, confront, follow, photograph, record or contact anyone shown in the Services. Any decision you make based on the Services, including where to go and what to do, is your own, and you assume all risks arising from it. Warden is not responsible for the actions of any person shown in, or using, the Services.

2.Not an emergency service#

Warden is an informational tool. It is not a substitute for 911, law enforcement, emergency services or professional security advice, and it does not monitor you, watch over you or send anyone to help you.

Alerts and notifications may be delayed, incomplete, not delivered or not triggered at all, for reasons including your device settings, network conditions, iOS restrictions on background activity, data provider delays and errors in our systems. Never rely on Warden as your only source of safety information. If you believe you or someone else is in danger, contact emergency services directly.

3.Public records data (sex offender registry information)#

Source

The Services display information published by government sex offender registries: the registries operated by U.S. states and territories, aggregated through the U.S. Department of Justice Dru Sjodin National Sex Offender Public Website (NSOPW). Warden does not create this information and does not verify it.

No guarantee

Public Records Data may be inaccurate, incomplete or outdated, and may not reflect the latest registry updates. Addresses may be approximate, and a pin’s position on the map may not correspond to a specific building. The absence of a record does not mean an area is free of risk. The official registry of the relevant jurisdiction is the only authoritative source: nsopw.gov.

Identity caution

Do not assume that a person is a registered offender because a name, photograph or address in the Services resembles theirs. Verify with the official registry before drawing any conclusion.

Permitted use

You may use Public Records Data only for your personal, non-commercial safety awareness.

Prohibited uses

You must not use Public Records Data, or the Services, to:

  • harass, threaten, intimidate, stalk, or commit any crime against a registered person or their family, neighbors or property;
  • engage in vigilantism of any kind;
  • publish, repost or distribute records to shame, expose or target anyone;
  • discriminate against anyone in employment, housing, credit, insurance, education, or any other area. Several state laws, including California’s Megan’s Law provisions (California Penal Code section 290.46), specifically prohibit using registry information for these purposes and impose civil and criminal penalties.

Warden is not a consumer reporting agency

Warden is not a consumer reporting agency as defined by the Fair Credit Reporting Act (15 U.S.C. section 1681 et seq.), and the Services and Content do not constitute consumer reports. You may not use the Services or any Content as a factor in determining any person’s eligibility for credit, insurance, employment, housing, or for any other purpose covered by the Fair Credit Reporting Act or similar laws.

Consequences of misuse

Misuse of Public Records Data results in immediate termination of your access. We cooperate with law enforcement, and you may face civil and criminal liability.

Corrections and removal requests

If you believe a record shown in the Services is inaccurate, outdated, or relates to you in error, write to contact@wardenmap.com. We review every request, direct you to the registry that publishes the record, and update or remove the record from the Services where appropriate or legally required.

4.Incident data, live events and safety indicators#

Incident Data (crimes, emergencies, police activity, fires, weather and similar events) comes from public and third-party sources. It may be unverified, delayed, inaccurate, incomplete or mislabeled, and may later be corrected or withdrawn. Pins on the map may be approximate. A report of an alleged crime is not a finding of guilt against anyone.

Some Incident Data describes events that are disturbing. By using the Services you accept that you may encounter such information.

Where the Services show safety indicators (such as areas to avoid, counts or scores), they are automated, aggregated and informational only. They are not a statement about any individual, resident or business, and not a guarantee of safety or danger anywhere. You must not use them for housing, lending, insurance or employment decisions, or to discriminate against any group or neighborhood.

Warden does not endorse, verify or guarantee third-party data and is not liable for it.

5.Location, notifications and device requirements#

The App asks for access to your location while you use it, to center the map on you and find nearby Content, and for permission to send notifications, to deliver alerts. Warden does not request background (“Always”) location. Without these permissions, parts of the Services will not work fully. You can change them at any time in iOS Settings.

You are responsible for having a compatible device and a supported version of iOS, for keeping the App updated, and for any data, carrier and internet charges you incur. Warden does not display third-party advertising.

6.Communications#

Operational messages about your account, security, billing and changes to the Services or these Terms are part of the Services, and we may send them by push notification, email or inside the App. We send marketing messages only with your consent where the law requires it, and every such message lets you unsubscribe. You can manage push notifications in the App and in iOS Settings.

7.Privacy#

Our Privacy Policy describes what information we collect, why, and how we share and protect it. By using the Services you agree that we may process your information in the United States and other countries where we and our providers operate, as described there, and you consent to that processing where the law requires consent.

8.Your account#

Warden does not require you to create an account. The App identifies your installation with an identifier created on your device, and purchases are tied to your Apple ID. If you connect an email to a purchase, you are responsible for keeping access to that email address and for all activity under your installation. Tell us at contact@wardenmap.com if you believe someone is using your access without permission.

You can delete your account at any time in the App, under Settings > About > Delete account. Deleting your account removes your data from our servers and restarts the App as a fresh install. Deleting your account does not cancel a subscription bought through Apple; cancel it in iOS Settings > Apple ID > Subscriptions.

9.Submissions and feedback#

The Services do not let you upload photos, videos or live streams, post publicly or message other users. The only things you send us are the details you enter for your own use (such as saved places and a display name), and feedback or support messages.

If you send us feedback, ideas or suggestions, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use them to operate and improve the Services, without any obligation to you and without compensation. We may also use them for no purpose at all.

10.Acceptable use and restrictions#

You agree not to do, or help anyone else do, any of the following:

  • scrape, crawl, mine, bulk download or otherwise extract Content from the Services, or build a database from it, including Public Records Data and Incident Data;
  • resell, sublicense, rent or otherwise use the Services or Content commercially, or use them to build a competing product;
  • reverse engineer, decompile or attempt to extract the source code of the App, except where the law expressly allows it;
  • probe, scan or test the security of the Services, bypass any protection, or interfere with the Services or the servers and networks that provide them;
  • spoof or falsify your location, send spam, frame or mirror the Services, or use automated means to access them;
  • use the Warden name, logo or marks without our written permission;
  • use the Services to harass, stalk, threaten, dox, discriminate against or incite violence against anyone;
  • use the Services for any purpose covered by the Fair Credit Reporting Act, or for any purpose that violates the law or these Terms.

We may access, preserve and disclose information where we believe in good faith that doing so is required by law, or is necessary to enforce these Terms, prevent fraud or abuse, respond to support requests, or protect the rights, property or safety of Warden, our users or the public.

11.License and intellectual property#

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on compatible devices that you own or control, subject to the applicable store terms, and to use the Site for your personal, non-commercial purposes. Use on Apple-branded devices is subject to the Usage Rules in the Apple Media Services Terms and Conditions.

The Services and all Content, including software, design, text, graphics, compilations of data and the Warden name and marks, are owned by 997 Labs FZC LLCor its licensors and protected by intellectual property laws. Nothing in these Terms transfers any of these rights to you. Public Records Data and Incident Data remain subject to the terms of their sources. Maps are provided by Apple Maps on iOS and by Google Maps on the Site and on Android, and are subject to Apple’s and Google’s terms.

12.Warden Premium: subscriptions and auto-renewal#

Premium unlocks the full Services, including complete registry records with names and photographs, alerts, and other features described in the App at the time of purchase. Features may change over time.

Premium is offered as an auto-renewing subscription, currently on a weekly or yearly basis, and from time to time at a promotional price for the first period. The price and the period are shown before you buy. Purchases on iOS use Apple In-App Purchase; purchases on Android use Google Play Billing; purchases on the Site are processed by Whop. The provider’s checkout and tax terms apply. We do not currently offer a free trial. Any future trial will disclose its duration, renewal price and cancellation deadline before you accept it.

Automatic renewal

Your subscription renews automatically for the same period at the then-current price unless you cancel before renewal. On Apple, cancel at least 24 hours before the end of the current period; payment is charged to your Apple ID at confirmation and renewal may be charged within 24 hours before the period ends. Manage Apple subscriptions in iOS Settings, under your name, then Subscriptions. On Android, manage or cancel in Google Play, under Payments & subscriptions, then Subscriptions. After cancellation, Premium normally stays active through the paid period. Deleting your account or uninstalling the App does not cancel a subscription.

Google Play purchases. Your use of Google Play is subject to the Google Play Terms of Service. Google Play processes Android payments using the payment method associated with your Google Account. You can manage your plan at Google Play subscriptions. Warden remains responsible for the App and support at contact@wardenmap.com.

Refunds.Purchases made through Apple are refunded by Apple under Apple’s policies; request one at reportaproblem.apple.com. Warden cannot issue refunds for App Store purchases. Google Play purchases follow Google Play’s refund policies and applicable law. For help with a Google Play or website purchase, contact contact@wardenmap.com.

Price changes. If the price of your subscription changes, the applicable billing provider will give any required notice and request consent where required by its policies or the law.

13.Suspension and termination#

You may stop using the Services at any time, delete your account in the App, and cancel any subscription through the provider you used to subscribe. We may suspend or terminate your access, with notice where reasonable, if you violate these Terms, misuse Public Records Data, create legal or security risk for Warden or others, or if we discontinue the Services. Except where the law or the billing provider’s policies require it, termination does not entitle you to a refund.

Sections 3, 4, 9, 10, 11, 12, 13, 14, 15, 16, 17, 19 and 20, and any other provision that by its nature should survive, survive termination of these Terms.

14.Disclaimers, limitation of liability, indemnity and release#

Disclaimer of warranties

The Services and Content are provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, to the maximum extent permitted by applicable law. We do not warrant that Public Records Data, Incident Data, safety indicators or alerts are accurate, complete, timely or available, that the Services will keep you safe or detect any danger, or that the Services will be uninterrupted or error-free.

You are free to, and should, contact 911 or your local emergency services directly. Decisions you make based on the Services are yours. Warden is not responsible for the acts or omissions of any third party, including any person shown in the Services. Features we label as beta or experimental are provided as-is, and our total liability arising from them is limited to USD 100. Links to other sites and data sources are provided for convenience; we are not responsible for them.

Limitation of liability

To the maximum extent permitted by applicable law, 997 Labs FZC LLC, its affiliates, officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to the Services or these Terms, however caused and under any theory of liability, even if advised of the possibility of such damages. To the same extent, we will not be liable for death, bodily injury or property damage arising from reliance on the Services or from the acts of any third party. Our total liability for all claims arising out of or related to the Services or these Terms will not exceed the greater of USD 100 or the amounts you paid us in the 12 months before the claim arose.

Indemnity

You agree to defend, indemnify and hold harmless 997 Labs FZC LLC and its affiliates, officers, employees and agents from any claims, damages, losses and expenses, including reasonable legal fees, arising out of or related to your use of the Services, your misuse of Public Records Data, your conduct toward any person shown in the Services, anything you submit to us, or your violation of these Terms or of any law or third-party right.

Release

To the maximum extent permitted by applicable law, you release 997 Labs FZC LLCand its affiliates, officers, employees, agents and licensors from all claims, demands and damages of every kind, known or unknown, arising out of or related to any dispute with another user or with any person shown in the Services, or to your reliance on the Services. If you are a California resident, you waive California Civil Code section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, and nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, willful misconduct or fraud where the law does not allow it. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted.

15.Governing law and dispute resolution#

These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules, and by the Federal Arbitration Act for the arbitration provisions below.

Informal resolution first

Before filing a claim, you and we agree to try to resolve it informally. Send a written notice describing the dispute and what you want to contact@wardenmap.com; we will send ours to the email connected to your installation, or to the address you give us. If the dispute is not resolved within 60 days of the notice, either side may proceed as set out below.

Binding individual arbitration

You and Warden agree that any dispute, claim or controversy arising out of or related to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either side may bring an individual claim in small claims court, and either side may seek emergency injunctive relief in court to protect intellectual property rights. The arbitration will be conducted remotely or in the county where you live, and fees are allocated under the AAA Consumer Arbitration Rules. The arbitrator’s award may be entered in any court of competent jurisdiction.

Class action and jury trial waiver

You and Warden each waive the right to a trial by jury and the right to bring or participate in any class, collective, consolidated or representative action. The arbitrator may award relief only to the individual party seeking it and only to the extent needed to resolve that party’s individual claim. If this class action waiver is found unenforceable as to a particular claim, then that claim, and only that claim, will be decided by a court, and the rest of these arbitration provisions remain in force.

Mass arbitration

If 25 or more similar arbitration demands are brought against Warden by or with the help of the same or coordinated counsel, the AAA will administer them in batches of up to 50, with one arbitrator and one set of fees per batch, and the remaining batches will be paused until each batch before them is resolved. The statute of limitations is tolled for claims in a paused batch.

Your right to opt out

You may opt out of arbitration by emailing contact@wardenmap.com within 30 days of first accepting these Terms, with your name, your Device ID (Settings > About > Device ID) and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Changes to this section

If we change this section after you accept these Terms, the change does not apply to any dispute of which you gave us written notice before the change took effect.

Courts

Any claim that is not subject to arbitration, and any action to enforce an arbitration award, must be brought in the courts of the State of Delaware, United States, and you consent to their jurisdiction.

If you live outside the United States▾

If you are a consumer in the European Economic Area, the United Kingdom, Switzerland or another country whose laws give consumers protections that cannot be waived, those protections apply to you, you may bring claims in the courts of your country of residence, and the arbitration and class action provisions above apply only to the extent the law of your country allows. If you live in Canada, your provincial consumer protection laws prevail over these Terms where they conflict.

16.Apple App Store terms#

When you use the App on an Apple device, the following terms also apply, as required by Apple.

  1. Acknowledgement. These Terms are between you and 997 Labs FZC LLC only, not with Apple Inc. ("Apple"). 997 Labs FZC LLC, not Apple, is solely responsible for the App and its content.
  2. Scope of license. Your license to the App is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
  3. Maintenance and support. 997 Labs FZC LLC is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services for the App.
  4. Warranty. 997 Labs FZC LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
  5. Product claims. 997 Labs FZC LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including: product liability claims; any claim that the App fails to conform to an applicable legal or regulatory requirement; and claims under consumer protection, privacy or similar laws.
  6. Intellectual property. In the event of a third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, 997 Labs FZC LLC, not Apple, is solely responsible for the investigation, defense, settlement and discharge of the claim.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer name and address. Questions, complaints or claims about the App go to 997 Labs FZC LLC, United Arab Emirates, contact@wardenmap.com.
  9. Third-party terms. You must comply with applicable third-party terms when using the App, such as your wireless data service agreement.
  10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

17.Copyright and intellectual property complaints#

If you believe that Content in the Services infringes your copyright or other intellectual property right, send a notice to contact@wardenmap.com or to our postal address in section 20, including:

  • your physical or electronic signature;
  • identification of the work you claim is infringed;
  • identification of the material you claim is infringing, with enough detail for us to locate it in the Services;
  • your name, address, telephone number and email address;
  • a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law;
  • a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.

We remove or disable access to infringing material when we receive a valid notice, and we terminate the access of repeat infringers.

18.Changes to the Services and to these Terms#

The Services evolve. We may add, change or discontinue features at any time. We may also update these Terms; the date at the top is when they last changed. If a change is material, we will tell you in the App or by email with reasonable notice before it takes effect. Continuing to use the Services after a change means you accept the updated Terms. If you do not agree, stop using the Services and delete your account.

19.General terms#

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Services.
  • No waiver. If we do not enforce a provision, we do not waive our right to enforce it later.
  • Severability. If a provision is found unenforceable, the rest of these Terms remain in force and the provision is enforced to the extent permitted, subject to the class action waiver rule in section 15.
  • Assignment. You may not assign these Terms. We may assign them, including in a merger, acquisition or sale of assets.
  • Notices. We may notify you by email, push notification or inside the App. Notices to us go to the addresses in section 20.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of Apple, our data providers or the internet.
  • No agency. Nothing in these Terms creates a partnership, employment or agency relationship between you and us.
  • Headings and language. Headings are for convenience only. The English version of these Terms controls over any translation.
